إذا ثبت هذا فأجمع المسلمون على أن حكم التلوط مع المملوك كحكمه مع غيره. ومن ظنّ أن تلوط الإنسان بمملوكه جائز» واحتجّ على ذلك بقوله تعالى: م إلا عل نجهم وما ملكت لينم فته عَب تين 42 [المعارج/ »]٠0 وقاس ذلك على أمته المملوكة» فهو كافر يُستتاب؛ كما يستتاب المرتد. فإنْ تاب وإلا ضربت عنقه. وتلوط الإنسان بمملوكه كتلوطه بمملوك غيره في الإثم والحكم.
