ولا ريب أنَ الزاجر الطبعي عن إتيان البهيمة أقوى من الزاجر الطبعي عن التلوّط» وليس الأمران في طباع [1/84] الناس سواءً؛ فإلحاق أحدهما بالآخر من أفسد القياس» كما تقدّم.

وأما قياسكم وطءٌ الرجل لمثله على تدالّك المرأتين؛ فمن أفسَّدٍ القياس» إذ لا إيلاج هناك» وإنما نظيره مباشرة الرجل الرجل من غير إيلاج؛ على أنه قد جاء في بعض الآثار المرفوعة: «إذا أتت المرأة المرأة فهما زانيتان»» ولكن لا يجب الحدّ بذلك لعدم الإيلاج» وإن أطلق عليهما اسم الزنى العامٌ» كزنى العين واليد والرجل والفم.
