في الأجوبة عما احتجّ به من جعل عقوبة هذه الفاحشة دون عقوبة الزنى

أما قولهم: إنّها معصية لم يجعل الله فيها حدًا معيْثّا؛ فجوابه من وجوه:

أحدها: أنّ المبلّمْ عن الله جعل حدٌّ صاحبها القتلّ حتمًاء وما شرعه رسول الله كَلِْةِ فإنّما شرعه عن الله. فإنُ أردتم أن حدّها غير معلوم بالشرع فهو باطل» وإن أردتم أنه غير ثابت بنصصّ الكتاب لم يلزم من ذلك انتفاء حكمه لثبوته بالسئة.
