وقتل المفعول به خير له من وطئه؛ فإنّه إذا وطئه الرجل قتله قتلٌا لا ترجى الحياة معه؛ بخلاف قتله فإنّه مظلوم شهيد» وربما ينتفع به في اخرته.

قالوا: والدليل على هذا أنَّ الله سبحانه جعل حدٌّ القاتل إلى خيّرة الوليّ » إن شاء قتل» وإن شاء عفا؛ وحتّم قتل اللوطي حدًاء؛ كما أجمع عليه أصحاب رسول الله كل ودلّت عليه سنّة رسول الله كَلة الصحيحة الصريحة التي لا معارض لهاء بل عليها عمل أصحابه وخلفائه الراشدين:
