وأما مسألة المال فقد اختلف فيهاء فقالت طائفة: إذا أدى ما عليه من المال إلى الوارث فقد برىء من عهدته في الآخرة» كما بريء منها فى الدنيا.

وقالت طائفة: بل المطالبةٌ لمن ظلمه بأخذه باقيةٌ عليه يوم القيامة؛ وهو لم يستدرك ظلامته بأخذ وارثه له فإنّه ملنعه من انتفاعه به فى طول حياته» ومات ولم ينتفع به. وهذا ظلم لم يستدركه هو » وإنما انتفع غيره باستدراكه.

وبنوا على هذا أنه لو انتقل من واحد إلى واحد وتعدّد الورثة كانت المطالبة به للجميع 6 لأنّه حقى كان يجب عليه دفعه إلى كل واحد منهم عند كونه هو الوارث. وهذا قول طائفة من أصحاب مالك وأحمد.

وفصل شيخنا بين الطائفتين» فقال: إن تمكن الموروث من أخذ ماله والمطالبة به فلم يأخذه حتى مات صارت المطالبة به للوارث في الآخرة» كما هي كذلك في الدنيا. وإن لم يتمكن من طلبه [1/73] وأخذه بل حال بينه وبينه ظلمًا وعدوانًا فالطلب له فى الآخرة.
