قالوا: وإذا كانت التوبة تمحو أثر الكفر والسحر وما هو أعظم إثمًاا من القتل فكيف تقصر عن محو أثر القتل؟ وقد قبل الله توبة الكفّار الذين قتلوا أولياءه؛. وجعلهم من خيار عباده» ودعا الذين [73/ب] حرّقوا أولياءه وفتنوهم عن دينهم إلى التوبة؛ وقال: « #كُلَ يِبَادِىَ آلَذينَ أرقا ع أنشسهخ لا تَتَتَطُوا ون رَحمَةٍ أله إنَ آله يَعْفِرُ الذوبَ جميعَا [الزمر/ 87]. فهذه في حق التاب: وهي تتناول الكثر وما دونه.

قالوا: وتوبة هذا المذنب تسليم نفسه» ولا يمكن تسليمها إلى المقتول» فأقام الشارع وليّه مقامّه؛. وجعل تسليم النفس إليه كتسليمها إلى المقتول 4 بمنزلة تسليم المال الذي عليه لوارثه 6 فإنّه يقوم مقام تسليمه للمورث.

والتحقيق فى هذه المسألة أنّ القتل يتعلق به ثلاث حقوق: حقّ لله وحقّ للمقتول 6 وحقّ للولي. فإذا سلم القاتل نفسه طوعًا واختيارً إلى الولى ندمًا على ما فعل» وخوفا من الله؛ وتوبة نصوحًاء سقط حقٌ الله بالتوبة؛ وح الولي بالاستيفاء أو الصلح أو العفو وبقي حقّ المقتول يعوضه الله عنه يوم القيامة عن عبده التائب المحسن 6 ويصلح بينه وبينه؛ فلا يذهب حقّ هذاء ولا تبطل توبة هذا.
