وهل يجتمع التعزير والكفارة في المعصية التي لاحد فيها؟ فيه وجهان. وهذا كالوطء في الإحرام والصيام ٠» ووطء الحائض» إذا أوجبنا فيه الكفارة. فقيل: يجب التعزير لما انتهك من الحرمة بركوب الجناية. وقيل: لا تعزير فى ذلك اكتفاءً بالكفارة» لأنها جابرة وماحية.
