وكذلك يعرض له أمران لا يمكن الجمع بينهماء ولا يحصل؟ أحدهما إلا بتفويت الآخرء فهذا موضع استعمال العقل والفقه والمعرفة. ومن هاهنا ارتفع من ارتفع: وأنجح من أنجح ٠ وخاب من خاب. فأكثرٌ من ترى ممن يعظم عقله ومعرفته يُثْرِ غير المهمٌ الذي لا يفوت على المهمٌ الذي يفوت. ولا تجد أحدًا يسلم من ذلك» ولكن مستقل ومستكثر.

والتحكيم في هذا الباب للقاعدة الكبرى التي عليها مدار الشرع والقدر» وإليها مرجع الخلق والأمر؛ وهي إيثارٌ أكبر المصلحتين وأعلاهماء وإن فاتت المصلحة التي هي دونها؛ والدخولٌ في أدنى المفسدتين لدفع ما هو أكبر منهاء فيفوات مصلحةً لتحصيل ما هو أكبر منهاء ويرتكب مفسدةٌ لدفع ما هو أعظم منها. فخطرات العاقل وفكره لا تتجاوز؟ ذلك. وبذلك جاءت الشرائع» ومصالح الدنيا والآخرة لا تقوم إلا على ذلك.
