فما كان الوازع عنه طبيعيً وليس في الطباع داع إليه اكتفى فيه بالتحريم مع التعزير ولم يرتّب عليه حدًا كأكل الرجيع؛ وشرب الدم؛ وأكل الميتة. وما كان في الطباع داع إليه رتب عليه من العقوبة بقدر مفسدته وبقدر داعي الطبع إليها.7

ولهذا لما كان داعي الطباع إلى الزنى من أقوى الدواعي كانت عقوبته العظمى أشنع القتلات وأعظمّها؛ وعقوبته السهلة أعلى أنواع الجلّْد مع زيادة التغريب. ولما كان اللواط فيه الأمران كان حدّه القتل بكل حال. ولما كان داعي السرقة قوبًا؛ ومفسدتها كذلك» قطع فيه اليد.

وتأَمّلْ حكمتّه فى إفساد العضو الذي باشرّ به الجناية؛. كما أفسد على (04/ب] قاطع الطريق يده ورجلّه اللتين هما آلة قطعه؛ ولم يُفُسِدُ على القاذف لسانه الذي جنى به» إذ مفسدة قطعه تزيد على مفسدة الجناية ولا تبلغهاء فاكتفى من ذلك بإيلام جميع بدنه بالجلد.
