وبهذا احتجّ الإمام أحمد على جواز الاستمتاع من المسبيّة قبل الاستبراء بغير الوطء» بخلاف الأمة المشتراة. والفرق بينهما أنّه لا يتوهّم انفساخ الملك في المسبيّة؛ بخلاف المشتراة فقد ينفسخ فيها؟ الملك» فيكون مستمتعًا بأمةٍ غيره.

وقد شفع النبيّ كَلةِ لعاشق أن تواصله معشوقته بأن تتزوج به؛ فأبت. وذلك في قصة مغيث وبريرة» فإنّه رآه يمشي خلفها بعد فراقهاء ودموعه تجري [33١/ب] على خذيه؛ فقال لها: «لو راجعتيه»!(؛) فقالت: أتأمرني يا رسول الله؟ قال: «لاء إنّما أشفع». فقالت: لا حاجة لي به. فقال لعمّه: «يا عبّاس ألا تعجّب من حب مغيثٍ بريرة؛ ومن بغضها له؟0 ولم ينكر عليه حبّها؛ إن كانت قد بانَتْ منه؛ فإن هذا ما لا يملكه.
